Introduction

Users Generally

• We may take any of the following actions in our sole discretion at any time and for any reason without giving you any prior notice: Limit, suspend, or terminate your access to all or any part of our Services; Change, suspend, or discontinue all or any part of our Services; Refuse, move, or remove any material that you submit to our sites for any reason; Refuse, move, or remove any content that is available on our sites; Limit or delete your accounts and all related information and files in your account; Cancel unconfirmed accounts; Establish general practices and limits concerning use of our sites. Each User hereby agrees that in no event shall chinaplccable.com be liable to the User or any third parties for any inability to use the Site, any delays, errors or omissions with respect to any communications or transmission, or any damage arising from the use of or inability to use the Site or any of its features.

• Users must use this Site solely for their own personal or internal purposes. Each User agrees that it shall not copy, reproduce or download any information, text, images, video clips, directories, files, databases or listings available on or through the Site (the "chinaplccable.com Content") for the purpose of re-selling or re-distributing the chinaplccable.com Content, mass mailing (via emails, wireless text messages, physical mail or otherwise), operating a business that competes with autodiag.de or otherwise commercially exploiting the chinaplccable.com Content. Systematic retrieval of chinaplccable.com Content from this Site to create or compile, directly or indirectly, a collection, compilation, database or directory (whether through robots, spiders, automatic devices or manual processes) without written permission from chinaplccable.com is prohibited. In addition, use of the content or materials for any purpose not expressly permitted in this Agreement is prohibited.

• As a condition of your access to and use of chinaplccable.com, you agree that you will not use the chinaplccable.com service to infringe the intellectual property rights of others in any way.

• Unauthorized access to our sites is a breach of these Terms and a violation of the law. Users agree not to access our sites by any means other than through the interface that is provided by chinaplccable.com for use in accessing our sites. Users agree not to use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, or copy any part of our sites, except those automated means that we have approved in advance and in writing.

• In case you become a registered or paying member of chinaplccable.com, you agree to accept responsibility for all activities that occur under your account or password, and agree you will not sell, transfer or assign your membership or any membership rights. You are responsible for maintaining the confidentiality of your password and for restricting access to your computer so that others may not access chinaplccable.com using your name in whole or in part.

• In case User got a password from us, you may not reveal it to anyone else. User is responsible for maintaining the confidentiality of your accounts and passwords. User agrees to immediately notify us of any unauthorized use of your passwords or accounts or any other breach of security. We will not be responsible for any loss or damage that may result if User fails to comply with these requirements.

• Each User hereby agrees that you will not use our sites to take any of the following actions: Post information contains false, fraudulent, inaccurate, misleading, defamatory, or libelous content (including personal information); Violate any laws (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising), third party rights, or our policies such as the Product Restrictions And Prohibition policies; Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; Publish, post, upload, e-mail, distribute, or disseminate (collectively, "Transmit") any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content; Transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person's computer, our sites, any software or hardware, or telecommunications equipment; Restrict or inhibit any other user from using and enjoying any public area within our sites; Interfere with or disrupt our sites, servers, or networks; Engage or promote in any illegal activities. Harvest or otherwise collect information about users, including personal information and public information without chinaplccable.com consent; otherwise create any liability for autodiag.de or its affiliates.

• We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We use your information only as described in the chinaplccable.com Privacy Policy. We view protection of users' privacy as a very important community principle. We store and process your information on computers that are protected by physical as well as technological security devices. Users can access and modify the information users provide us and choose not to receive certain communications by signing-in to your account. For a complete description of how we use and protect your personal information, we urge that users read chinaplccable.com'Privacy Policy which governs the protection and use of each User's information in chinaplccable.com'possession. Each User hereby accepts the Privacy Policy and any updates and amendments thereto. Each User acknowledges that chinaplccable.com may change the Privacy Policy from time to time provided that chinaplccable.com shall make available the updated version of the Privacy Policy on the Site at all times. Your continuation of use of the Site shall be deemed to be your acceptance of the Privacy Policy which is then displayed on the Site at the time of such use.

Release

• If users have a dispute with one or more users, users release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Resolution of Disputes 

• If a dispute arises between you and chinaplccable.com, we shall attempt in the first instance to resolve such dispute through friendly consultation. We strongly encourage you to first contact us directly to seek a resolution before you resort other means. Accordingly, you and chinaplccable.com agree that we will resolve any claim or controversy by litigation unless otherwise agreed in writing.


• This Agreement shall be governed by the laws and regulations of the People's Republic of China. The parties to this Agreement hereby submit to the exclusive jurisdiction of the courts of the People's Republic of China.  

Miscellaneous

• Subject to any additional agreements, this Agreement and the Privacy Policy constitute the entire agreement between the User and chinaplccable.com with respect to access to and use of the Site, superseding any prior written or oral agreements in relation to the same subject matter herein.


• chinaplccable.com and the User are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.


• chinaplccable.com may amend this Agreement at any time by posting the amended and restated Agreement on the Site. The amended and restated Agreement shall be effective immediately upon posting. Posting by chinaplccable.com of the amended and restated Agreement and your continued use of the Site shall be deemed to be acceptance of the amended terms. This Agreement may not otherwise be modified, except in writing by an authorized officer of chinaplccable.com.


• If any provision herein is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.


• Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.


• chinaplccable.com's failure to enforce any right or failure to act with respect to any breach by a User under these terms and conditions will not waive that right nor waives chinaplccable.com's right to act with respect with subsequent or similar breaches.


• chinaplccable.com shall have the right to assign its obligations and duties in this Agreement and in any agreement relating to Premium Services to any person or entity.
